You are granted a limited license only, subject to the restrictions provided in these Terms, for purposes of viewing the material contained on this Website.

The user is not permitted to submit any AI-generated content. Boomerang Effect Pty Ltd does not currently use AI tools to deliver coaching services but reserves the right to do so in the future, in conjunction with its Privacy Policy. Boomerang Effect Pty Ltd reserves the right to remove any of Your Content from this Website at any time, and for any reason, without notice.

Any personal information collected through your use of this Website or submission of content is handled in accordance with our Privacy Policy, available at https://www.johnnovaksport.com/privacy-policy/. 15.  Artificial Intelligence Policy

15.1  Definitions

For the purposes of this section, “Artificial Intelligence” or “AI” means any software, system, tool, model or service that uses machine learning, deep learning, natural language processing, generative AI, large language models (LLMs), AI agents, automated scraping tools, or similar technologies, whether operated by a human or autonomously.

15.2  Prohibition on Use of Our Content to Train AI

No content published on this Website, including but not limited to text, images, audio, video, worksheets, coaching programs, methodologies, templates, and any other material owned by or licensed to Boomerang Effect Pty Ltd, may be used to train, fine-tune, evaluate, or otherwise develop any Artificial Intelligence model or system, without prior written consent from Boomerang Effect Pty Ltd.

This prohibition applies to:

  • direct input of content into AI tools, chatbots, or LLMs;
  • automated scraping, harvesting, or extraction of content for AI training purposes;
  • use of content as part of any dataset, corpus, or training set; and
  • indirect reproduction of content via AI-generated paraphrasing or summarisation for AI training.

15.3  Prohibition on Automated Access

You must not access, crawl, index, or interact with this Website using any automated tool, bot, AI agent, or web scraping software. All access to this Website must be conducted by a human user through a standard web browser, unless prior written permission has been obtained from Boomerang Effect Pty Ltd.

15.4  User-Submitted Content and AI

You must not submit any AI-generated content to this Website, including but not limited to text, images, worksheets, or responses generated by any AI tool. By submitting content to this Website, you warrant that the content is your own original work and has not been generated in whole or in part by any AI system.

15.5  Our Use of AI

Boomerang Effect Pty Ltd does not currently use AI tools to deliver coaching services. We reserve the right to introduce AI-assisted tools in the future, subject to updates to these Terms and our Privacy Policy. Where AI tools are used on this Website, including any chatbots or AI assistants, we will clearly disclose this to users.

Any content generated by AI tools on this Website is provided for general information purposes only. It does not constitute professional, medical, legal, psychological, or sports performance advice. You should seek independent professional advice before acting on any AI-generated information.

15.6  Indemnity for AI Misuse

In addition to the general indemnity in Section 7, you agree to indemnify and hold harmless Boomerang Effect Pty Ltd and its officers, directors and employees from and against any claims, losses, damages, costs, and expenses (including reasonable solicitor’s fees) arising from:

  • your use of our content to train, test, or develop any AI model or system;
  • your submission of AI-generated content to this Website; or
  • any breach of this Section 15 by you or any party acting on your behalf.
